1. The service
SEMAOS provides email marketing automation and sales engagement software. We process the emails you create and deliver them via Amazon SES; we track opens, clicks, bounces, and unsubscribes; we expose those metrics in dashboards. See our home page and pricing page for the current feature surface.
2. Your account
- You're responsible for keeping your login credentials safe. We recommend WebAuthn passkeys over passwords; both are available.
- You're responsible for the accuracy of the data you upload — especially your business's physical mailing address, which is required in every commercial email by CAN-SPAM.
- Account-holders must be 18 or older and authorised to bind their organisation.
3. Acceptable use
You agree not to use SEMAOS for any of the following — sending them is grounds for immediate suspension and account termination:
- Unsolicited bulk email (“spam”) to recipients who did not opt in.
- Email containing content prohibited by US law: fraud, harassment, illegal goods or services, child exploitation, violent extremism.
- Phishing, malware distribution, or impersonation of any party, including SEMAOS itself.
- Circumventing the suppression list — sends to addresses that have unsubscribed or hard-bounced are blocked at the platform level; attempting to bypass that block is itself a violation.
We monitor aggregate bounce + complaint rates. Tenants whose rates exceed 5% / 10% are throttled / suspended automatically — see the in-app deliverability dashboard for details.
4. Billing & refunds
- Plans are billed monthly or annually via Stripe. The current tiers and prices are listed on our pricing page.
- The 30-day free trial does not require a credit card for CRM-adapter tenants, and charges $0 upfront for standalone tenants (a card is required to deter abuse).
- Plan changes take effect immediately. Downgrades apply right away; we don't refund the unused portion of the higher tier you were on.
- On-demand bank top-ups are non-refundable. Unused balance stays in your account indefinitely.
- If you dispute a charge, contact support@semaos.io before initiating a chargeback. Chargebacks initiated without first contacting us may result in account termination.
5. Suspension & termination
We may suspend or terminate accounts that violate these terms, that fail to pay invoices, or that abuse our deliverability infrastructure. You may close your account at any time from settings; data is retained for 30 days post-closure (per our Privacy Policy) and then purged.
6. Service availability
We aim for 99.9% monthly uptime but don't currently offer a contractual SLA on standalone plans. Enterprise customers negotiate uptime + support SLAs as part of their agreement. Scheduled maintenance is announced via in-product banner at least 24 hours in advance when possible.
7. Intellectual property
You retain ownership of the content you create — email templates, contact lists, sequences. By using the service you grant SEMAOS a limited licence to store, render, and deliver that content for the purpose of fulfilling the service.
The SEMAOS software, brand, and documentation are the property of DevilDog Lab LLC and are not licensed to you beyond the right to use the service.
8. Limitation of liability
To the maximum extent permitted by law, SEMAOS's liability for any claim arising from the service is limited to the fees paid in the 12 months preceding the claim. We are not liable for indirect or consequential damages.
9. Governing law
These terms are governed by the laws of the State of Delaware, USA. Disputes that can't be resolved through good-faith communication go to binding arbitration in Delaware.
10. Changes to these terms
Material changes are announced via in-product banner + email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
